فعالية القيود الدستورية في حصر مجال التشريع بأوامر

Résumé: نظـم الدستور الجزائري سلطة رئيس الجـمهورية في مجال التـشريع بأوامر، حيث لم يجـعل هذه السلطة تمـارس بصفة مطـلقـة ، بل أحـاطـها الدســتور بمجــموعة من القيـــود والضوابط بإعتبارها سلطة استثنائية ، والتي تستـشف من خــلال قـــــراءة المــادة 142 من الدستور والتي عدلت بموجب تعديل سنة 2016 ، وعدلـت كذلك بموجب تعديل سنة 2020 ، حيث أضاف المؤسـس الدسـتوري في التعديليــن السابقيــن قيــود جــديدة على سلطة رئـيس الجــمهورية في مجــال التـشريع بأوامـــر، وذلك من أجـل تجـسيد مبــدأ حصر مجال التشريع بالأوامر، فضلاً عن تعزيز مبدأ الرقابة سواء كانت برلمانية أو دستورية ، وعليه نجد أن سلطة رئيس الجمهورية في مجال التشريع بأوامر مقيدة من الناحية الزمنية، الموضوعية والشكلية ، وتهدف هذه الورقة البحثية إلى دراسة مدى فعالية هذه القيود لحصر مجال التشريع بالأوامر ، وحماية اختصاص السلطة التشريعية العام في إعداد القوانين. الكلمات المفتاحية: التشريع بأوامر؛القيود الدستورية.
