العوامل المؤثرة في تقدير التعويض عن الفعل الضار

Résumé: ملخص: يهدف هذا البحث الى بيان أهمية الظروف الملابسة في تقدير التعويض عن الضرر وخاصة وأن التشريعات المقارنة منحت القاضي سلطة واسعة عند تقدير التعويض وذلك للوصول الى تعويض عادل ، لذلك يقع على عاتق القاضي الاخذ بعين الاعتبار الظروف الملابسة طبقا لنص المادة 131من القانون المدني ، ومن النتائج المتصل اليها : ان مبدأ التعويض الكامل لا يقيم وزناً إلا لعنصر واحد وهو حجم الضرر الفعلي الذي تكبده المضرور دون أن يعتد بظروف المسؤول ، أما التعويض العادل فهو يسمح بمعالجة بعض الحالات الواقعية التي تقتضي فيها العدالة مراعاة ظروف المسؤول والمضرور على حد سواء ، كما أن عناصر الضرر التي تتدخل في حساب التعويض من مسائل القانون التي تخضع لرقابة محكمة النقض. كلمات مفتاحية : التعويض ، الضرر ، السلطة التقديرية ، المسؤولية . Abstract: The purpose of this research is to demonstrate the importance of circumstances in assessing compensation for the damage, especially since comparative legislations gave the judge broad authority in assessing compensation in order to achieve fair compensation, so the judge has to take into account the circumstances set forth in the article 131 of the Civil Code. The related results include: The principle of full compensation assesses only one element: The extent of the actual damage suffered by the injured without any consideration of the circumstances of the responsible and fair compensation allows for the treatment of certain factual situations where justice requires both responsible and injured circumstances to be taken into account. The elements of harm involved in the calculation of compensation are also matters of law under the control of the Court of Cassation. Key words: Compensation, damage, discretion, liability
