الحصانة الدبلوماسية وأحكامها ( دراسة مقارنة بين الشريعة الإسلامية والقانون الدولي)

Résumé: "يقصد بالحصانة الدبلوماسية حماية ومنعة وحرمة المبعوث الدبلوماسي وما يتعلق به، من كل ما يعيق أداءه لوظيفته، نشأت قديما ثم تطورت عرفيا وغلب عليها مبدأ المعاملة بالمثل، إلى أن جاء الإسلام فشرعها وبيَن أحكامها وأرسى معالمها، وعرفت طفرتها في العصر الحديث، مع ظهور اتفاقية فيينا للعلاقات الدبلوماسية سنة 1961م. تستند الحصانة الدبلوماسية في الشريعة الإسلامية إلى عقد الأمان، وكذلك لمقتضى الوظيفة، أما في القانون الدولي فتستند إلى العديد من النظريات منها نظرية التمثيل الشخصي، ونظرية الامتداد الإقليمي، ونظرية مقتضى الوظيفة والتي تعتبر الأنسب عند الكثير من القانونيين، ويشمل نطاقها كل من الحصانة الشخصية والمالية والقضائية، وتعطى في الشريعة الإسلامية بصورة نسبية، أما فقهاء القانون الدولي فيقولون بالحصانة المطلقة."
