Résumé: تعتبر الرقابة على دستورية القوانين ضمانة لتكريس سمو الدستور، ومن المستقر عليه فقها تقسيم هذه الرقابة إلى رقابة سياسية وأخرى قضائية، غير أن تطور الحياة الدستورية تجاوز هذا التقسيم إلى إيجاد تصور حديث لطبيعة الرقابة على دستورية القوانين. تهدف هذه الورقة البحثية إلى تسليط الضوء على كل الاتجاهات الفقهية وتقييم الآراء التي استند عليها كل منهم، لتخلص الدراسة إلى أنه رغم أهمية النقاش الفقهي حول طبيعة الرقابة على دستورية القوانين في الجزائر، إلا أن أكثر ما يهم هو مدى فعالية هذه الرقابة عمليا. Oversight of the constitutionality of laws is a guarantee of consolidating the supremacy of the constitution, and agreed on divide this oversight into political and judicial. However, a new concept of censorship has emerged. This research paper aims to shed light on all the jurisprudential trends and evaluate the opinions on which each of them was based. The study concludes that despite the importance of the jurisprudential discussion about the nature of oversight on the constitutionality of laws in Algeria, what matters most is the effectiveness of this oversight in practice.
