قضاء الاستعجال في مادة التسبيق المالي: مقاربة مقارنة بين القانونين الجزائري والفرنسي
Résumé: تتناول هذه الورقة البحثية بالدراسة والتحليل قضاء استعجال التسبيق المالي، بوصفه تدبيرا يهدف إلى توفير معالجة سريعة للنزاعات ذات الطابع المالي التي قد تثور بين الإدارة والخواص، وذلك وفق مقاربة مقارنة، تستهدف بحث الإطارين الموضوعي والإجرائي لهذا القضاء في النظامين القانونيين الجزائري والفرنسي، بغية الوصول إلى تحديد النظام الأكثر فعالية في تحقيق الأهداف المبتغاة من وراء تكريس هذا الإجراء، وتحديد مواضع القصور في نظامنا القانوني للعمل على إصلاحها. Abstract: This research paper examines and analyzes the referred-provision, as a measure aimed at providing quick treatment of conflicts of a financial nature that may arise between administration and private law persons, based on a comparative approach aimed at examining the substantive and procedural frameworks of this judiciary in the algerian and french legal systems, in order to determine the most effective system in achieving the desired objectives of this procedure, and to identify deficiencies in our legal system to work towards reform
