الوضعية القانونية للطفل مجهول النسب في الجزائر : بين حق اكتساب اللقب و ضياع الحق في النفقة

Résumé: الملخص: يعتبر الحق في الرعاية و الهوية و الانتماء من اهم الحقوق التي يجب ان يتمتع بها كل طفل سواء كان له سند قانوني او مجهول النسب ، على اعتبار ان حقوق الطفل واحدة و هي جزء لا يتجزأ من حقوق الانسان مهما كانت وضعيته ، و في ظل الفراغ القانوني لتخصيص نصوص تشريعية خاصة بفئة الأطفال مجهولي النسب ،منح القانون الجزائري لهذا الطفل بعض الحقوق و لعل أهمها اكتساب حق الحصول على لقب عائلي ، غير ان بعض الحقوق يمكن ان يفقدها عند فك الرابطة الزوجية خاصة في غياب نص قانوني يحمي حقه في النفقة . Abstract: The right to care, identity and belonging is one of the most important rights that every child, whether legally supported or of unknown descent, must enjoy, considering that the rights of the child are the same and are an integral part of human rights , regardless of their status, and under the legal vacuum of allocating legislative provisions for this category, Algerian law granted this child certain rights , perhaps the most important of which is the acquisition of the right to a family title within the framework of a system of family title. Bail, however, some rights can be lost when the marital bond is dismantled, especially in the absence of a legal provision protecting his right to maintenance.
