صلاحية الوزير الأول في تنظيم حقوق وحريات الأفراد في ظل جائحة كورونا

Résumé: الملخص: يثير موضوع انتشار الأوبئة الاهتمام بموضوع حقوق وحريات الأفراد، التي قد يمس بها من خلال تنظيم الأثار المترتبة عليها، إذ بادرت الحكومة الجزائرية باتخاذ سلسلة من المراسيم التنفيذية لمواجهة انتشار فيروس كورونا المستجد، وفي ظل عدم تدخل البرلمان صاحب الاختصاص الأصيل في تنظيم حقوق وحريات الأفراد ، ونظرا لعدم إعلان رئيس الجمهورية حالة الطوارئ الصحية التي تم اتخاذها في مجموعة من دول العالم، قد يثار التساؤل عن سبب عدم تنظيم الآثار المترتبة على انتشاره من قبل رئيس الجمهورية(مراسيم رئاسية)، وتولي ذلك من الوزير الأول(مراسيم تنفيذية)، ومدى صحة ودستورية تدخله في هذه الحالة؟ حيث تبين بعد التعمق في هذه الإجراءات التي جاءت في إطار حجر صحي منزلي ضمن خطة طوارئ صحية كان بفعل الضرورة مما من شأنه إحداث تغيير في مفهوم القانون. الكلمات المفتاحية: المراسيم التنفيذية؛ أزمة كورونا، الحقوق؛ حدود شكلية؛ اختصاص الوزير الأول. Abstract: The spread of epidemics raises interest in the issue of the rights and freedoms of individuals, which may be affected by there organization, as the Algerian government initiated a series of executive decrees to confront the spread of the new Corona virus, and in light of the lack of intervention of Parliament, and In light of non-interference of the President of the Republic to declare the health emergency, the question may arise as to why the effects of the spread of the Krone virus in Algeria are not regulated by the President of the Republic , and About the constitutionality of the intervention of the Prime Minister by (executive decrees in this case . To answer the question we relied on a critical analytical approach, giving our personal opinion whenever needed.
