دراسة تحليلية للقانون رقم 23 /21 فيما يتعلق بحماية الغابات من الحرائق

Résumé: ملخص : تلعب الغابات دور ايكولوجيا هاما اذ تؤثر ايجابيا في تحقيق التوازن البيئي فهي هبة من الله عز وجل على الارض ،بحيث تتمتع الجزائر بمساحات غابية شاسعة حضائر و محميات طبيعية ما يستدعي التفاني في حمايتها و الحفاظ على دوامها و نظرا لما مسها من كوارث و اضرار مؤخرا جراء الحرائق المهولة سوآءا الطبيعية منها او المفتعلة التي اتت على الثروة الغابية و المتكررة سنويا ما دفع المشرع الى تحيين المنظومة القانونية المتعلقة بها و نص قانون جديد يحمي الثروات الغابية من كل اشكال الاعتداد و يسد بعض الهفوات سوآءا من حيث الحماية الاستباقية الوقائية من جهة و الردعية العقابية من جهة اخرى . As a divine gift, forests play an exceptionally crucial ecological role by positively impacting environmental balance. Algeria is blessed with vast forested areas, habitats, and natural reserves that particularly necessitates the dedication of both protective and preservative efforts. Recent and repetitive disastrous damages caused by catastrophic wildfires, of both incendiary and arsenous nature, have underscored the reactive, legislative urgency for the safeguarding and sustainability of this vital resource .Consequently, the legislature has proceeded with the revision of the legal framework pertaining to forests ,enacting a new protective law of forestry resources from all forms of encroachment and addressing .existing shortcomings, involving both the proactive, preventive measures and the deterrent, punitive actions
