حماية المستهلك من الشروط التعسفية في عقود الإستهلاك

Résumé: لطالما حاول المشرع التصدي لمختلف الشروط التي تتضمن تعسفا في شتى المجالات،وذلك بالنص عليها في القواعد التقليدية غير أنه أمام التطورات التي شهدتها السوق اليوم وزيادة إنتاج السلع وتنوع الخدمات ما دفع الطرف القوي مقدم السلعة أو الخدمة إلى تحرير نماذج تضم مثل هذه التصرفات نظرا لكثرة التعاملات وسرعتها في اليوم الواحد، لم تعد هذه القواعد كفيلة بمواجهة الشروط التعسفية التي تضمها هذه العقود ما دفع المشرع إلى البحث عن وسائل أخرى أكثر نجاعة للحد من مثل هذه الشروط، سواء عن طريق إنشاء لجنة الشروط التعسفية، أو عن طريق تدخل القاضي في تعديل الشروط التي يراها مجحفة في حق أحد الطرفين رغم ما لهذا من تأثير على أهم مبدأ في التعاقد وهو مبدأ سلطان الإرادة، وذلك بهدف إعادة التوازن بين الطرفين المتعاقدين، غير أنه يبقى سؤال مطروح :هل أن هذه الآليات كفيلة فعلا للحد من الشروط التعسفية نهائيا، أم أنها تبقى مجرد حبر على ورق؟.
