العقد الإداري الالكتروني بين مبدأ المشروعية وحدود النص القانوني

Résumé: ارتبطت العقود الإدارية بفكرة الإدارة العامة ، ومظاهر السلطة العامة، وتأصيلها الوثيق عليها ،حيث تغلب فكرة المرونة العقدية على قواعد القوة الملزمة للعقد، من خلال بروز فكرة المصلحة العامة لمقتضيات المصلحة العامة، بواسطة امتيازات السلطة العامة التقليدية المتعارف عليها . والدولة الحديثة اليوم هي دولة القانون ن القائمة على الرشادة الحكمية ، والترشيد الإداري ومن هذا المنطلق، وفي ظل عصرنة العملية الإدارية في مختلف ركائزها ، جاءت فكرة المقال ، للإجابة من خلالها على : إشكالية تطبيقات المشروعية الإدارية Administrative contracts were associated with the idea of public administration, and the manifestations of public authority, and its close rooting on it, as the idea of contractual flexibility overcomes the rules of binding force of the contract, through its emergence. For the idea of the public interest to the requirements of the public interest, through the prerogatives of traditional public authority. From this point of view, and in light of the modernization of the administrative process in its various pillars, the idea of the article came to answer through it: the problem of the applications of administrative legitimacy, when talking about administrative contracts in the electronic environment.
