حماية أجر العامل من خلال أحكام قانون العمل الجزائري

Résumé: لقد عرف القانون الاجتماعي تطورا هاما في مجال العمل، ساهم في توسيع دائرة الحماية للعامل الطرف الضعيف في علاقة العمل، حيث فضله بكثير من الامتيازات، ومن جملتها الأجر باعتباره أهم التزام يقع على عاتق صاحب العمل. لذلك يعتبر موضوع الأجور من أهم الموضوعات التي لاقت اهتمام الكثير من الباحثين في مجال الإدارة. وعليه فإن مسألة الاجور تحظى بالاهتمام البالغ من طرف كل من المؤسسة والعمال والدولة على حد السواء. فبالنسبة للعامل يمثل الأجر دخله الأساسي يسعى من خلاله رفع مستوى معيشته وإشباع حاجاته، وبالنسبة للمؤسسة يمثل الأجر نفقة الإنتاج، حيث يتسنى لصاحب العمل تحقيق أكبر ربح ممكن. أما بالنسبة للدولة فهي تهدف إلى حماية الأجر عن طريق أجهزتها حفاظا على علاقات العمل من جهة، وعلى الاستقرار الاقتصادي و الاجتماعي من جهة أخرى. Abstract: Social law has known an important development in the field of work, which contributed to the expansion of the protection circle for the worker (for the weak party in the work relationship), as he has many privileges, including wages as the most important obligation on the employer. Therefore, the issue of wages is one of the most important topics that have attracted the attention of many researchers in the field of management. Therefore, the issue of wages receives great attention from the institution, workers and the state alike. For the worker, the wage represents his basic income through which he seeks to raise his standard of living and satisfy his needs. As for the institution, the wage represents the expense of production, whereby the employer can achieve the largest possible profit. As for the state, it aims to protect the wage through its agencies in order to preserve labor relations on the one hand, and economic and social stability on the other.
