نطاق المسؤولية الجزائية في حالة السُّكْر من منظور التشريع الجزائري The Scope Of Criminal Liability In The Case Of Drunkenness From The Perspective Of Algerian Legislation

Résumé: إن ظاهرة تناول المواد المسكرة ظاهرة إجتماعية خطيرة كونها ارتبطت بارتكاب مختلف الجرائم، حيث يقوم العديد من الأشخاص بارتكاب جرائمهم وهم في حالة سكر لما تصاحبه من تأثيرات عضوية و نفسية على الإنسان، و منه أضحت المسألة محل اهتمام رجالات القانون من تحديد أثر المسؤولية الجزائية فيها، و عليه سنحاول من خلال هذه الورقة البحثية تسليط الضوء على حدود تقرير المسؤولية الجزائية من عدمها في حالة تناول مثل هذه المواد وفقا للتشريع الجزائري، و ما مدى توفيقه في ذلك، مع إبراز الثغرات القانونية إن وجدت، دون إطالات مملة أو اختصارات مخلة. The phenomenon of consuming drunkenness substances is a dangerous social phenomenon, as it has been associated with the committing of various crimes Indeed, many people commit their crimes while drunk due to the organic and psychological effects on them the issue has become a matter of interest for legalists as to determine the impact of criminal responsibility Accordingly, we will try through this research paper, to shed light on the limits of the criminal liability when taking products that lead to drunkenness according to Algerian legislation, and to what extent is has successed in that while highlighting the legal loopholes if there is any.
