مستجدات العدالة الدستورية في الجزائر في ظل تجربة المحكمة الدستورية

Résumé: في إطار التعديلات الدستورية الواسعة والعميقة التي أقرتها دستور أول نوفمبر سنة 2020، أدخل المؤسس الدستوري الجزائري مجموعة من المستجدات على الهيئة التي استحدثها باسم "المحكمة الدستورية" مكان المجلس الدستوري. وهي مستجدات طرأت على الاختصاصات التي ورثتها عن المجلس الدستوري، ومستجدات مسّت شروط اختيار أعضائها وتعيين رئيسها، ومستجدات أُخَر وسَّعَت دورها الرقابي، ودورها في تفسير الدستور، والفصل في الخلافات بين السلطات الدستورية... وهو أمر فيه دلالة ومؤشر على التمكين للعدالة الدستورية وترسيخها. In the context of the broad and profound constitutional amendments approved by the Constitution of 1st November 2020, the Algerian constitutional founder introduced a set of developments to the body he created in the name of the “Constitutional Court” in place of the Constitutional Council. These are developments in the competencies it inherited from the Constitutional Council, developments affecting the conditions for selecting its members and appointing its president, and other developments that have expanded its oversight role, and its role in interpreting the constitution, and settling disputes between constitutional authorities... which is an indication and an indication of the empowerment and consolidation of constitutional justice
