أثر المقاصد في نوازل كورونا -نماذج مختارة- The Impact Of Employing Purposes In The Calamities Of Corona- Selected Models

Résumé: إن الأحداث المتجددة التي يشهدها العصر الحاضر وما أفرزته من مسائل ومستجدات يؤكد الحاجة الملحة لتجدد اجتهادات الفقهاء لتواكب التطور الذي تشهده الحياة الإنسانية، ولهذا كان حري بالفقهاء أن يبنوا اجتهاداتهم على أسس النظر المقاصدي، حتى تكون أحكامهم صحيحة موافقة لغايات الشرع ومراعية لفقه الواقع، وحسن تنزيل النصوص مع النظر للمآلات، ومن هنا تبرز أهمية توظيف المقاصد في الاجتهاد المعاصر. وقد حاولنا في هذا البحث تسليط الضوء على نازلة كورونا، من خلال الكشف عن مواطن توظيف العلماء للمقاصد في بعض المسائل المستجدة بسبب كورونا بهدف بيان حكمها الشرعي. وخلصنا إلى أن لعلم المقاصد أهمية بالغة لاسيما للفقيه حتى يحسن استنباط الأحكام الشرعية لما استجد من نوازل، كما أن لنازلة كورونا عظيم الأثر حيث أفرزت لنا عدة مسائل دعت الحاجة للوقوف على حكمها من خلال عرضها على ميزان المقاصد. The renewed events in the current era and developments they have produced confirm the need to renew the jurisprudence of jurists to keep pace with the development of life. This is way jurists must employ objectives in their ijtihad, so that their rulings are correct and consistent with the goals of sharia, reality, and consideration of the results. Here the importance of employing objectives in contemporary ijtihad modern. In this research, we tried to uncover the calamity of Corona, by showing scholars use of objectives in some new issues due to Corona in order to know their legal ruling. And we have concluded that the science of objectives is of great importance to the jurist in order to extract the legal rulings for new calamities, and the Corona disaster has had a great impact as it has produced for us several cases that need to show their ruling by presenting them the scale of objectives
