ضمانات استقلالية خلية معالجة الاستعلام المالي في مواجهة السلطة التنفيذية

Résumé: أنشأ المشرع الجزائري في إطار سعيه للوقاية من الفساد ومكافحته العديد من الهيئات والمؤسسات التي تضطلع بهذه المهمة، وقد خصص لمجال تبييض الأموال، باعتباره طبقا للمادة 42 من قانون الوقاية من فساد ومكافحته إحدى أعقد وأخطر جرائم الفساد، هيئة مستقلة أطلق عليها تسمية "خلية معالجة الاستعلام المالي". كيف المشرع خلية معالجة الاستعلام المالي سنة 2012، بموجب الأمر رقم: 12/02، وأيضا المرسوم التنفيذي رقم: 13/157 بالسلطة الادارية المستقلة، كما اعترف لها بالشخصية المعنوية والاستقلال المالي. وقد حاولنا من خلال هذه المداخلة القاء الضوء على الضمانات العضوية والوظيفية التي وفرتها النصوص، من أجل تكريس استقلالية حقيقية لهذه الخلية في مواجهة السلطة التنفيذية، نظرا لخطورة المهام الموكلة لها، في إطار مكافحة جريمة تبييض الأموال. إلا أن معالجة النظام القانوني الخاص باستقلالية هذه الهيئة، جعلنا نجزم أنها استقلالية نسبية، تعرف حدودا تتعلق أساسا بعدم الانسحاب الكلي للدولة من تأطير ورقابة نشاط الخلية، ورغبتها بالتواجد على مستوى هذه السلطة بشكل أو بآخر، من خلال آليات رقابية عضوية، وأخرى وظيفية. As part of its efforts to prevent and combat corruption, the Algerian legislator has established several bodies and institutions that carry out this task.The money laundering field has been designated as one of the most serious crimes in accordance with Article 42 of the Anti-Corruption Law, In this regard, the legislator established An independent body called : « the Financial inquiry processing Cell ». How the legislator Financial Information Cell in the year of 2012, under Order N° 12/02, and also Executive Decree N° 13/157 of the Independent Administrative Authority, also recognized her moral personality and financial independence. We have tried through this intervention to shed light on the organic and functional guarantees provided by the texts, in order to ensure its independence in the face of the executive authority. However, the treatment of the legal system concerning the independence of this body has made it certain that it is a relative autonomy, which defines the limits related mainly to the total withdrawal of the state from the supervision and control of the cell's activity, and its desire to be present at the level of this authority in one form or another, through organic and functional control mechanisms.
