الرؤية الدستورية للحق في البيئة بموجب التعديل الدستوري لسنة 2020

Résumé: يعتبر الدستور و ما تحمله نصوصه من مبادئ أساس كل تطور تشريعي في الدولة ، فمن بين هذه المبادئ المكرسة دستوريا "مبدأ الحق في البيئة" ،في حين تعتبر هذه المساعي الدستورية انعكاس لمجموعة من الالتزامات الدولية المبرمة في المجال البيئي، بالإضافة إلى الوضعية الصعبة التي ألت إليها البيئة في الجزائر بسبب الفرط في النمو الصناعي مع غياب دراسات توقعية و وقائية للآثار السلبية الناتجة عنه ،لذا تهدف هذه الدراسة لتحديد الرؤية الدستورية للحق في البيئة في التعديل الدستوري لسنة 2020،و ذلك من خلال التطرق لمكانة هذا الحق في الدستور الجزائري ،و كذا تحديد حقيقة دسترته و تسليط الضوء على الجدل القائم في هذا الشأن . The constitution and its articles are the basis of every legislative development in the state. Among these constitutionally enshrined principles is ”the principle of the right to the environment”, while these constitutional initiatives are the reflection of a set of international commitments in the environmental fielded, in addition to the difficult situation that has come to it. the environment in Algeria due to excessive industrial growth with the absence of predictive and preventive studies of the negative effects resulting from it, so this study aims to determine the constitutional vision of this right to the environment, by addressing the status of this right in the Algerian constitution, as well as determining the truth of its constitution and shedding light on the controversy about this regard.
