أحكام نفقة الأولاد دراسة مقارنة بين القانون العراقي و(الشريعة الإسلامية، التشريعات العربية) The Provisions Of Children's Support A Comparative Study Between Iraqi Law And (islamic Law & Arabic Legislation)

Résumé: يتناول هذا البحث أحكام نفقة الأولاد في قانون الأحوال الشخصية العراقي مقارنة بالشريعة الإسلامية والتشريعات العربية. والغرض منه هو التعرّف على مدى استيعاب القانون العراقي للأحكام المذكورة واقتراح نصوص قانونية في حالة وجود ثغرات تشريعية. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي والمقارن. واختتم البحث بنتائج وهي: أن القانون العراقي يعتريه فراغ تشريعي كبير فيما يخص هذه الأحكام بحيث أن النصوص الحالية غير قادرة على تغطيتها، ولذلك اقترحنا مواد قانونية بديلة ضمن توصيات هذا البحث. This research deals with the provisions of children's support in Iraqi personal status law comparing to Islamic law and Arabic legislations. Its purpose is to identify the extent to which the Iraqi law includes the aforementioned provisions and to suggest legal texts in the event of legislative loopholes. In order to achieve that, the researcher used the inductive analytical and comparative method. The research was concluded with results, which are: The Iraqi law has a major legislative loophole with regard to these provisions, as the current legal texts are unable to cover them. Therefore, we suggested alternative legal articles within the recommendations of this research.
