أثر الجائحة كوفيد-19 في سياسة التجريم و العقاب في قانون العقوبات الجزائري

Résumé: إن غياب تشريع خاص بالأزمات دفع المشرع إلى خلق نصوص تتناسب والوضعية الوبائية التي تمر بها الجزائر والعالم، حيث يظهر تأثر قانون العقوبات بالجائحة عن طريق القانون 20-06 الذي تضمن استحداث بعض الجرائم ويتعلق الأمر بتجريم نشر الأخبار الكاذبة وتعريض الغير للخطر، كما تضمن الأمر 20-01 قواعد تتعلق بحماية مهنيي الصحة والمؤسسات والهياكل التابعة لها من الاعتداءات التي تطالهم في الأوضاع العادية وخلال الأزمات، كما تم استحداث بعض الظروف المشددة التي يرتبط مفهومها مع ظهور الوباء ويتعلق الأمر بالحجر الصحي والكوارث المتنوعة، وأيضا اعتماد بعض العقوبات المشددة خاصة في الأمر 20-01 نظرا للظروف التي تمت فيها صياغة النصوص. The absence of crisis legislation has pushed the legislator to create texts commensurate with the epidemiological situation that Algeria and the world are going through, by introducing Law 20-06, which included the introduction of some crimes in which the legislator was affected by the existence of the pandemic and the beginning of its spread, and it is related to criminalizing false news and exposing Others are at risk. Order 20-01 also includes rules elating to the protection of health professionals and their institutions and structures from attacks that affect them in normal situations and during crises.
