التمييز بين الأشباه والنظائر والفروق الفقهية

Résumé: تعتبر مصطلحات الأشباه والنظائر والفروق الفقهية من أكثر المصطلحات الفقهية تداولا، مع أنها محل خلاف في مراد مستعمليها منها، حيث يجعلها بعضهم أسماء متعددة لشيء واحد، بينما آخرون يجعلون الأشباه والنظائر مترادفين، والفروق أمر ثاني، فالقسمة عندهم ثنائية، في حين فريق ثالث يعد المصطلحات الثلاث أسماء لثلاثة أنواع من المسائل الفقهية. ومن هنا جاءت هذه الدراسة للكشف عن هذه الحقيقة، وتمييز المصطلحات المذكورة عن بعضها، ورفع اللبس والإشكال الذي غالبا ما يقع عند مطالعة الكتب التي تناولت مباحث الفروق الفقهية أو الأشباه والنظائر، إضافة إلى إبراز أوجه الاتفاق والاختلاف بينها The Jurisprudential terms of “elAchbah”, “Nadair” and “Ferouk Fikhia” (Jurisprudential differences) are considered one of the most Jurisprudential used terminology, although it generates some conflicts in intentions of their users. Some of those users make it multiple names of one thing, while others think that “elAchbah” and “Nadair” are synonyms and “Ferouk Fikhia” are a whole other thing. A third opinion says that the three terms are names of three different Jurisprudential cases. And from here, came this study to reveal this fact, and to distinguish between each one of the three terminology, and to get rid of the confusion that might occurred when reading a books about the “Ferouk Fikhia” (Jurisprudential differences) studies or “elAchbah and Nadair”, and to highlight points of agreement and disagreement between each.
