آليات تحسين مناخ الاستثمار في ظل القانون 23-17 المحدد لشروط وكيفيات منح العقار الاقتصادي.

Résumé: يشكل العقار الاقتصادي حجر الزاوية في تطوير مناخ الاستثمار ونظرا لأهمية التي يكتسيها ومن اجل الرفع من المستوى الاقتصادي وجلب المستثمرين عمل المشرع على وضع اليات تسمح للمستثمرين من الاستفادة من العقار الاقتصادي من خلال إصداره للقانون 23-17 المحدد لشروط وكيفيات منح الامتياز على الأملاك الخاصة للدولة والموجهة للاستثمار والذي بموجبه ألغي احكام الامر السابق 08-04 وتطبيقا له أصدر المشرع المرسوم التنفيذي 23-486 والمرسوم التنفيذي 23-487 واللذان من خلالهما حدد شروط وكيفيات ابرام عقود الامتياز حيث بين من خلالها مختلف الإجراءات و الاحكام المتعلقة بهذا المنح على تسهيل عملية استغلال العقار الاقتصادي الذي يعتبر بدوره الركيزة الأساسية لإقامة المشاريع الاستثمارية. Abstract: Economic real estate constitutes the cornerstone in developing the investment climate. Given the importance it holds, and in order to raise the economic level and attract investors, the legislator worked to develop mechanisms that allow investors to benefit from economic real estate through issuing Law 23-17 specifying the conditions and methods for granting concessions on private and state-owned property. For investment, according to which the provisions of the previous Order 08-04 were cancelled, and in implementation thereof, the legislator issued Executive Decree 23-486 and Executive Decree 23-487, through which it specified the conditions and methods for concluding concession contracts, through which it clarified the various procedures and provisions related to these grants to facilitate the process of exploiting economic real estate. Which in turn is considered the basic foundation for establishing investment projects.
