تفرد الوكالة الجزائرية لترقية الاستثمار بإدارة وتسيير العقار الصناعي (قراءة في أحكام القانون رقم 23-17)

Résumé: يهدف هذا البحث إلى تسليط الضوء على التعديلات المحدثة على الإطار المؤسساتي الخاص بضبط العقار الصناعي، والتي جاء بها قانون 23-17 المحدد لشروط وكيفيات منح العقار الاقتصادي التابعة لأملاك الدولة الموجه لإنجاز مشاريع استثمارية، وتوضيح المقاربة المعتمدة من طرف السلطات العمومية لتحسين مناخ الاستثمار، والكشف عن جديد الصلاحيات المسندة للوكالة الجزائرية لترقية الاستثمار المتمثلة أساسا في تفردها بضبط إدارة واستغلال العقار الصناعي، من خلال تمكينها من بعض الآليات التقنية لمعالجة إشكال ندرة العقار الصناعي وتفشي ظاهرة البيروقراطية الادارية، بمنحها صلاحية مباشرة اجراءات تطهير العقار الصناعي واكتساب عقار الخواص باسم الدولة، بالإضافة الى ذلك وضع تحت تصرفها منصة رقمية خاصة بالمستثمر تتولى مهام إيداع ومعالجة طلبات المستثمرين، يستهدف من خلالها تكريس مبادئ الشفافية والمساواة التي تعد من أهم عوامل جذب الاستثمار. This research aims to shed light on the updated amendments to the institutional framework for controlling industrial real estate, which were included in Law 23-17 specifying the conditions and modalities for granting economic real estate belonging to state property directed to the implementation of investment projects, and clarifying the approach adopted by the public authorities to improve the investment climate, and disclose Renewing the powers assigned to the Algerian Investment Promotion Agency, which are mainly represented in its uniqueness in controlling the management and exploitation of industrial real estate, by empowering it with some technical mechanisms to address the problems of scarcity of industrial real estate and the spread of the phenomenon of administrative bureaucracy, by granting it the authority to direct the procedures for disinfecting industrial real estate and acquiring private real estate in the name of the state, in addition to This placed at its disposal a digital platform for investors that undertakes the tasks of depositing and processing investor requests, through which it aims to establish the principles of transparency and equality, which are among the most important factors for attracting investment.
