حماية حقوق كبار السن: دراسة مقارنة في الآليات القانونية الدولية والوطنية. Protecting The Rights Of The Older Persons: A Comparative Study In International And National Legal Mechanisms.

Résumé: يهدف هذا المقال إلى بيان الحماية القانونية و المؤسساتية لفئة كبار السن باعتبارها فئة هشة ضاعف فيروس كوفيد-19 من التحديات الوجودية التي تواجهها، في ظل انعدام اتفاقية دولية خاصة بهم، وقد ملأت الاتفاقيات الإقليمية والمبادئ التوجيهية الفراغ إذ وضعت معايير دولية كفيلة بتحسين حالهم. أما على المستوى الوطني فقد أقر المشرع قانونا متكاملا لحماية المسنين وهو القانون رقم 10-12 واتبعه بعدد مهم من المراسيم، ارتقى من خلالها ابتداء من سنة 2010 بحقوق المسن في الجزائر إلى المعايير الدولية المطلوبة، إعمالا لمبدأ عدم التمييز في التمتع بحقوق الإنسان على أساس السن، إلا أن التجسيد العملي لهذه القواعد يبقى بعيدا عن المأمول. This article aims to explain the legal and institutional protection of older persons that the Covid-19 virus has multiplied the existential challenges they face, in the absence of a special international agreement, the regional agreements and guidelines have filled the void by setting international standards that can improve their situation. On the national level, the legislator approved an integrated law to protect the older persons N 10-12 and several decrees, in harmony with international standards, in implementation of the principle of Non-discrimination in the enjoyment of human rights on the basis of age, but the practical embodiment of these rules remains far from the hope.
