إبرام عقد الترخيص بإستغلال براءة الإختراع

Résumé: المعلوم أنّ لصاحب براءة الاختراع أن يتصرف فيها باستعمالها واستغلالها، ومن تمّ يجوز له الترخيص للغير باستغلال البراءة بموجب عقد ترخيص يسمى "عقد الترخيص باستغلال براءة الاختراع". ولمّا كان عقد الترخيص باستغلال براءة الاختراع من العقود الحديثة نسبيا، فان المشرع الجزائري لم يخصه بتشريع خاص مستقل، بل اكتفى بالإشارة إليه في الأمر رقم 03-07 المتعلق ببراءة الاختراع كحق ممنوح لصاحب البراءة. وعقد الترخيص باستغلال براءة الاختراع باعتباره عقدا شأنه شأن أيّ عقد من العقود الأخرى، لينعقد صحيحا لا بدّ من أن تتوافر فيه أركانه وشروط صحته، الأمر الذي يدفعنا إلى التساؤل عن ماهية هذا العقد، وأهم مراحل تكوينه، وهو ما سنحاول الإجابة عنه في هذه الدراسة. It is known that the holder of patent has right to use and exploited it, for that he can permit the others to exploit it too. As the contract of exploiting patent is from the modern contracts, the Algerian legislator didn't give it a special and independent legislation but it refers to it in the decree 03-07 which is related to patent as a right to the holder. By considerate the contract of exploiting patent like the other contracts, to held it true, it must contains its pillars and conditions of validity which push us to ask: What is this contract?, what are most steps of its formation? All that we will try to answer than in this study.
