قاعدة تصرف الإمام على الرعية منوط بالمصلحة زمن الحجر الصحي – كوفيد 19 – The Rule Of “ The Guardian’s Behavior To The Subjects Is Vested With The Interest ” During The Time Of The Quarantine Due To Covid-19

Résumé: الملخص: تعتبر قاعدة (تصرف الإمام على الرعية منوط بالمصلحة) من أمهات القواعد في باب السياسة الشرعية؛ وذلك لما ترتبه من آثار في انضباط تصرفات وحركة الأفراد، حيث تهدف هذه الورقة البحثية لتكشف عن بيان هذه القاعدة، وذكر بعض التطبيقات المتعلقة بالحجر الصحي المتزامن مع وباء كوفيد 19. إذ يسوغ لولي الأمر؛ أن يقيد استعمال حق الأفراد بالقدر الذي يصون به المصلحة العامة، كما يحق له أن يتدخل في شؤون الأفراد، والنظر في مآل أفعالهم إذا كانت ترتب أضراراً وفساداً بالغير يقيناً، أو ظناً منعت درءً لمآلها، وحسماً لمادة الفساد بقدر الإمكان والوسائل المفضية إليه، وهذا مقصد عام يجب مراعاته في جميع شؤون الدولة الاقتصادية والاجتماعية والسياسية، فللدولة أن تسن القوانين التي تدفع الضرر المتوقع عن الأفراد والجماعة، وهو ما جسدته السلطة التنفيذية في نصوصها التنظيمية التي تزامنت ووباء كورونا كوفيد 19. Abstract: The rule of (the guardian’s behaviour to the subjects is vested with the interest) is considered as one of the key rules in the chapter of the legal policy, and because of the importance of its implications on individuals’ actions and movement discipline, this paper aims to clarify the concept of this rule and mention some applications related to the quarantine coinciding with COVID-19 epidemic. It is permissible for the guardian to restrict the use of individuals rights to the extent that safeguards the public interest, as he has the right to intervene in the individuals' affairs and consider the outcomes of their actions if they might harm others or generate corruption, whether this is certainly or suspiciously prohibited in order to ward off their results, resolution of corruption as much as possible and the means leading to it as well. This is a general intention that must be taken into account in all economic, social and political aspects of the state. So, it has the authority to enact appropriate laws to fend off the expected harm on individuals and groups, which is embodied by the executive authority in its organizational texts that synchronized with the COVID-19 pandemic.
