الوساطة الجنائية – دراسة مقارنة بين التشريعين الجزائري والفرنسي- The Criminal Mediatation – Comparative Study Between Algerian And French Legislation

Résumé: ملخص أمام عجز العدالة الجنائية عن معالجة الأزمة التي يعرفها قطاع القضاء ظهرت آليات إجرائية بديلة عن تحريك الدعوى الجنائية، التي من بينها نظام الوساطة الجنائية الذي يهدف إلى حل نزاع نشأ عن جريمة يتم التفاوض بشأنها بين الأطراف المعنية، والذي كان من المفترض أن يحسم عبر إجراءات الدعوى الجنائية، الذي أثبت فعاليته في أغلب التشريعات التي تبنته لاسيما التشريعات اللاتينية، وفد اتبع المشرع الجزائري نفس النهج من خلال تبنيه نظام الوساطة الجنائية بموجب الأمر رقم 15-02 المؤرخ في 23/7/2015 من خلال المواد من 37 مكرر إلى 37 مكرر 9، وكذا القانون المتعلق بحماية الطفل رقم 15-12 المؤرخ في 15-7-2015 من خلال المواد من إلى الكلمات المفتاحية: الوساطة الجنائية، التشريع الجزائري، التشريع الفرنسي، الوسيط.
