التحكيم التجاري الدولي كضمانة للمستثمر الأجنبي International Commercial Arbitration As A Guarantee For The Foreign Investor

Résumé: ملخص: يشكل الإستثمار الأجنبي المناخ الملائم لترقية الإقتصاد الوطني والنهوض به خاصة في ظل وجود حركة رؤوس الأموال بين الدول، مما يتطلب وجود حماية فعالة للمستثمر الأجنبي على الصعيدين الوطني والدولي، و عليه فإنه نظرا للأهمية الكبيرة التي يلعبها الإستثمار، فقد تم تكريس التحكيم كضمانة تشريعية لفض النزاعات التي قد تثور بين الدولة المضيفة والمستثمر الأجنبي. والجدير بالذكر أن المشرع الجزائري بدوره حاول تكريس التحكيم، كآلية لفض المنازعات من خلال منظومته التشريعية خاصة في ظل قانون رقم 16-09 المتعلق بترقية الإستثمار، وجعله من أهم الضمانات القانونية الممنوحة للمستثمر الأجنبي وهذا بهدف جلب المستثمر الأجنبي للجزائر، و خلق بيئة إستثمارية فعالة بالإضافة إلى الإتفاقيات الدولية التي إنضمت إليها الجزائر والتي تكرس حماية فعالة خاصة في ظل الحرية المكرسة للأطراف في اختيار طريق فض النزاعات، وهذا راجع للدور الذي تلعبه في تشجيع هذا النوع من الإستثمارات. Abstract: Foreign investment constitutes the appropriate climate for the promotion and advancement of the national economy, especially in light of the existence of capital movement between countries, which requires effective protection for the foreign investor at the national and international levels, and accordingly, the great importance that investment plays, arbitration has been devoted as a legislative guarantee. To settle disputes that may arise between the host country and the foreign investor. It is worth noting that the Algerian legislator, in turn, tried to devote arbitration as a mechanism for resolving disputes through his legislative system, especially in light of Law No. 16-09 related to the promotion of investment, and made it one of the most important legal guarantees granted to the foreign investor and this is with the aim of attracting the foreign investor to Algeria, and creating an investment environment Effective in addition to the international convention to which Algeria has acceded and which devote effective protection, especially in light of the freedom devoted to the parties to choose the way to settle disputes, and this is due to the role it plays in encouraging this type of investment.
