المستجدات العلمية لزراعة الأعضاء البشرية في ضوء الشريعة الإسلامية

Résumé: الملخص: يتناول البحث قضية زراعة الأعضاء البشرية ، ويسلط الضوء على موضوع الاستنساخ البشري العلاجي العضوي، والمعالجة باعتبارهما مستجدات علمية دخلت حيز التطبيق بقصد تعزيز فرص نجاح زراعة الأعضاء البشرية، وإثراء سبل ممارسته، ويبين مقتضى الحكم الشرعي لكل منهما، وبيان أقوال أهل العلم بخصوصهما، وقد خلصنا بعد مرحلة التصوير إلى أن العلماء داخل المختبرات يسعون فعلا لإثراء مصادر الأعضاء البشرية من خلال الاستنساخ والخلايا الجذعية، وخلصنا بعد مرحلة التكييف إلى أن الحكم الشرعي لهذه البدائل العلاجية إنما يكون من باب التفصيل لا الإجمال، وأن الانتفاع بها مرهون ومرتبط بوقفة شرعية تمحيصية تُحدد المشروع فيها ومنها فتجيزُه، وتحدد المحظور فتمنعه. الكلمات المفتاحية: الحكم الشرعي/ زرع الأعضاء/ استنساخ الأعضاء/ الخلايا الجذعية. Abstract: The research examines the case of human organ transplantation and highlights the subject of therapeutic human cloning, and stem cell treatment as scientific developments that entered recently intoforce with a view to enhancing the chances of successful human organs transplantation, and explaining the requirement of the Islamic sharia provisions of each of them. After the definition phase, we concluded that scientists in the laboratories are seeking to enrich the sources of human organs through cloning and stem cells. After the legitimacy decision phase, we concluded that the legitimate provision of these therapeutic alternatives is detailed rather than total, and that their use is subject to and linked to a legitimacy decision that determines the permitted and allow it, and specifies the forbidden and ban it.
