الحماية القانونية للمحضون في ظل قانون 01/24 المتضمن لتدابير خاصة للحصول على النفقة The Legal Protection Of The Child Under Law 24/01 Containing Special Measures To Obtain Alimony

Résumé: تعتبر النفقة بعد الطلاق حسب قانون الأسرة الجزائري جزء من الرعاية الشرعية والقانونية للأطفال، وهي تساهم في تأمين حياة كريمة وتلبية احتياجاتهم الأساسية، اذ يجب على الأب أن يتحمل هذه المسؤولية بما يضمن أفضل مصلحة لأبنائه بعد الطلاق، غير أن الواقع العملي كشف عن صعوبة تحقيق المشرع للهدف الكامل للتجريم في العديد من الحالات، لذلك، قام بتوفير مجموعة من الآليات التي تضمن حماية المحضون من أي ضرر. وقد تمثل ذلك في إصدار عدة قوانين، من بينها القانون 15/01، الذي ألغي بموجب المادة 22 من القانون الجاري دراسته 24/01، المتضمن لتدابير خاصة للحصول على النفقة، لتخفيف المعاناة التي يواجهها المحضون عند الحكم بالنفقة، بسبب امتناع المدين عن أداء التزاماته، فإنه هذا القانون يضمن دفع النفقة شهريًا وفق شروط وضوابط محددة. Alimony after divorce according to the Algerian Family Code is part of the legitimate and legal care for children, and it contributes to securing a decent life for them and meeting their basic needs, as the father must bear this responsibility in a way that guarantees the best interest of his children after divorce. The practical reality, however, revealed the difficulty faced by the legislator in achieving the full goal of criminalization in many cases, so he provided a set of mechanisms that ensure the protection of the child from any harm. This was reflected in the issuance of several laws, including Law 15/01, which was repealed by Article 22 of the Law 24/01 under review that includes special measures to obtain alimony to alleviate the suffering faced by the child when there is a ruling on alimony due to the debtor’s failure to perform his obligations. With this law, the legislator guarantees the payment of alimony monthly according to specific conditions and regulations.
