استرداد العائدات الاجرامية في اتفاقية الامم المتحدة لمكافحة الفساد -الاليات والعقبات-

Résumé: نظرا للطابع الدولي لجرائم الفساد المالي و نظرا للتطور التكنولوجي في مجال الاتصالات، وعلى مستوى المصارف والمؤسسات المالية التي أصبحت تتم التحويلات البنكية فيها إلكترونيا ،فإنّ هذا ساعد على تسهيل إيجاد الملاذات الآمنة للعائدات الإجرامية بغية إخفائها ثم إعادة إدخالها للدولة من جديد على أنها أموال نظيفة، من هنا برزت أهمية توحيد الجهود وذلك من أجل استرداد هذه العائدات وإعادتها للبلدان التي سلبت منها لتنفيذ خططها التنموية. من خلال هذه المقال سنتناول بالدراسة واقع استرداد العائدات الإجرامية من أجل تشخيص ظاهرة تسرب الأموال الفاسدة من جهة ، ثم آليات استرداد هذه العائدات التي نصّت عليها إتفاقية الأمم المتحدة لمكافحة الفساد و العمل على تقييم هذه الآليات بالوقوف على نقاط نجاحها وقصورها في مجال الاسترداد. الملخص باللغة الانجليزية: Due to the international nature of the crimes of financial corruption and due to the technological development in the field of communications, and at the level of banks and financial institutions where bank transfers are made electronically, this has facilitated the creation of safe havens of criminal proceeds in order to conceal and re-enter the state again as clean money, Hence the importance of unifying efforts to recover these revenues and return them to the countries that were deprived of them to implement their development plans. In this article, we will examine the reality of the recovery of criminal proceeds in order to diagnose the phenomenon of the leakage of corrupt funds on the one hand, and the mechanisms for the recovery of these revenues stipulated in the United Nations Convention against Corruption and work on evaluating these mechanisms to identify their points of success and shortcomings in the field of recovery.
