مقاصد أحكام العِدّة وأثرها في حُكم استبراء المعتدّة عن طريق الكشف الطبي

Résumé: الملخص: أوجب الإسلام العِدّة على المرأة بعد وفاة زوجها، وبعد حَلِّ عَقد النكاح بطلاق أو خلع أو غير ذلك من وسائل فُرق النكاح لتحقيق مقاصد عظيمة، والتي من أهمها التأكد من استبراء المعتدة من الحمل، حماية من اختلاط الأنساب، ومع تطور الطب في وقتنا المعاصر، وقدرته على معرفة وجود الحمل من عدمه عند المعتدة في وقت مبكر، أثيرت مسألة حكم الاعتماد على الكشف الطبي في استبراء المعتدة، وفي هذا البحث أبين أهم مقاصد أحكام العدة ومدى تأثيرها في حكم استبراء المعتدة عن طريق الكشف الطبي. الكلمات المفتاحية: مقاصد أحكام العدة، استبراء المعتدة، الكشف الطبي. Abstract: Islam requires a woman a waiting period after her husband's death, resolving the marriage contract by divorce from the man or at instance of wife who pays compensation or whatever other means of marriage separation to achieve great purposes. The most important of which is to verify that the woman in a waiting period is not pregnant in order to avoid mixing genealogies With the development of medicine in our time and its ability to know if the woman in a waiting period is pregnant or not in early time, the issue of what does the Islamic law say in relying on medical disclosure to purify the woman in a waiting period? is raised.
