الحماية التقنية لحقوق المؤلف في النشر الإلكتروني The Technical Protection Of Author’s Rights In Electronic Publishing

Résumé: إن بروز النشر الإلكتروني كآلية للإنتاج الفكري على دعامة إلكترونية، وقصور النصوص القانونية عن توفير الحماية الفعالة لها، أدى بأصحاب الحقوق إلى استحداث تدابير تقنية ذاتية تعمل كحماية وقائية للحقوق المؤلف المنشورة عبر شبكة الأنترنت من الاعتداء عليها. مما أدى إلى بروز الحماية التقنية كآلية أساسية ومكملة للحماية القانونية، عن طريق استعمال وسائل تكنولوجية لمنع استغلال الغير شرعي لهذه الحقوق بدون مقابل مادي. وبالرجوع للتشريع الجزائري فإنه صادق على معاهدة الويبو الأولى والثانية، وبالتالي تدخل أحكامهما ضمن النظام القانوني الداخلي الواجب التطبيق، بالإضافة إلى الاعتراف بالتشفير والتوقيع الإلكتروني كآليتين للحفاظ على أمن البيانات والمعلومات، وبالتالي يمكن استغلها لحماية مصنفات الرقمية. The emergence of the electronic publishing as a mechanism to provide an electronic pillar For the intellectual production , and the short coming of legal provisions to provide the effective protection had led the rights holders to create their own technical measures as a preventive protection for the an electronic pillar rights published online to protect from being abused. Therefore the technical protection emerged as the main mechanism that completes the legal protection through the adoption of technologies against any illegal exploitation to these rights without financial compensation. With reference to the Algerian legislation, it ratified the first and second wipo copyright and therefore their povisious are included in the applicable domestic legal system in addition to its encryption recognition and electronic signature as mechanisms for data and information security and then the possibility to use them to protect digital works.
