ترجيح رواية صاحب القصة وأثره في أحاديث الأحكام

Résumé: اهتم العلماء بجمع الأحاديث المتعارضة ظاهريا، وجعلوا للخروج من هذا التعارض مسالك: الجمع والترجيح والنسخ، ومن طرق الترجيح التي اعتمدوها الترجيح برواية صاحب القصة، وذلك لأنه لديه مزية في ضبط وإتقان الحديث على غيره، وترجيح رواية صاحب القصة لها خمسة شروط: تعذر الجمع بين الحديثين، وعدم ثبوت النسخ بينهما، ثانيا عدم وجد علة قادح في سند الحديثين، ثالثا عدم وجود دليل خارجي، رابعا أن لايكون الحديث المعارض متواترا، خامسا وجود صاحب القصة في سند أحد الحديثين، ولما كانت الأحكام تبنى على الأحاديث، وخاصة على الراحج منها كان لترجيح رواية صاحب القصة أثر في الأحكام. The scholars were concerned about the collection of the apparently contradictory conversations, and they made out of this contradiction the paths of: combination, weighting and copying, and the weighting methods adopted by the weighting story of the author of the story, because it has the advantage in controlling and mastering the talk to others.
