الطرق العلمية لإثبات النسب في التشريع الجزائري. Scientific Methods To Prove Lineage In The Algerian Legislation

Résumé: يعد إثبات النسب مشكلة اجتماعية خطيرة بالغة الأهمية وخطيرة في نفس الوقت، شغلت بال الفقهاء والعلماء والقانونيين في جميع أقطار العالم، ناهيك على أنه ينجر عنه مشاكل قضائية قد تستغرق وقتا طويلا في أروقة المحاكم وتضرب الأسرة في استقرارها ومكانتها الاجتماعية. وقد أدخل المشرع الجزائري تعديلا على قانون الأسرة بالأمر 05-02 من أجل مواكبة التطورات العلمية والطبية الحديثة فألقى بثماره على المادة 40 منه، مما فتح الباب أمام القضاء لإجازته اللجوء إلى هذه الطرق العلمية لإثبات النسب(زيادة على النسب التقليدي)، فكان لها الأثر البالغ على أدلة الإثبات(البصمة الوراثية) المنصوص عليها. Proof of lineage is a very important and dangerous social problem that has occupied the minds of scholars, scholars and jurists in all countries of the world, not to mention that it leads to judicial problems that may take a long time in the corridors of the courts and strike the family in its stability and social position. The Algerian legislator introduced an amendment to the family law by order 02-05 in order to keep pace with modern scientific and medical developments, and it cast its fruits on Article 40 of it, which opened the door to the judiciary to allow it to resort to these scientific methods to prove lineage (in addition to the traditional lineage), which had a great impact On the evidence of proof (genetic fingerprint) stipulated.
