عن دستورية الإجراءات المتخذة لمواجهة فيروس كوفيد 19

Résumé: لقد دفع الانتشار الرهيب لوباء فيروس كورونا -كوفيد19- العديد من الدول إلى الإعلان عن حالة الطوارئ الصحية من أجل السيطرة على الوضع الصحي، ذلك وفق ما تقتضيه النصوص الدستورية و التشريعية للدولة. في حين آثرت السلطات الجزائرية السيطرة على الوضع الصحي بطريقة مختلفة من خلال تولي السلطة التنفيذية مسؤولية الحفاظ على الصحة العامة.و عليه نسعى من خلال هاته الدراسة تسليط الضوء على كيفية تعامل السلطة مع هذا الوضع غير الاعتيادي، و مدى التزامها بالنصوص الدستورية. The terrible spread of the coronavirus -covid19- epidemic has prompted many countries to declare a state of health emergency in order to control the health situation, This is in accordance with the requirements of the constitutionnal and legislative texts of the state. Meanwhile the algerian authorities have chosen to control the health situation in a different way, by assuming the executive authority responsible for maintaining public health. And we seek through this study to shed light on how the authority deals with this unusual situation and the extent of its commitments to the constitutionnal texts. La terrible propagation de l’épidémie de coronavirus –covid19- a incité de nombreux payés à déclarer l’état d’urgence afin de contrôler la situation sanitaire, ce ci est conforme aux exigences des textes constitutionnels et législatifs de l’état. Parallèlement, les autorités algériennes ont choisis de maitriser la situation sanitaire d’une manière différente en assumant l’autorité exécutive chargée du maintien de la santé publique ; et nous cherchons a travers cette étude à éclairer la manière dont l’autorité gère cette situation inhabituelle et l’étendu de son engagement envers les textes constitutionnels.
