Résumé: ملخص تماشيا مع التطورات الحاصلة في مجال الأعمال والتجارة وضرورة جذب المستثمرين وتحسين مناخ الأعمال ومايترتب عنه من منازعات تجارية ذات طبيعة خاصة،وفي سبيل إيجاد آليات فعالة لتسويتها توجه المشرع الجزائري نحو تكريس نظام قضائي متخصص للنظر في المنازعات التجارية ذات طبيعة خاصة بما يحافظ على عنصري السرعة والإئتمان اللذان يقوم عليهما النشاط التجاري بهدف تحقيق عدالة منجزة وسريعة. حيث أجرى تحديث في التنظيم والتقسيم القضائيين، وذلك بموجب التقسيم القضائي رقم07-22 المؤرخ في 2022/05/05،وكذا تعديل قانون الاجراءات المدنية والإدارية بموجب القانون رقم 22-13 حيث كرس فكرة القضاء المتخصص بإستحداث نظاما خاصا بالمحاكم التجارية، وأسند لها صلاحية الفصل في بعض القضايا التي تختص بالنظر فيها دون سواها بتشكيلة قاض وأربع مساعدين يتمتعون بالكفاءة والفاعلية للفصل في المنازعات التجارية، بالإضافة إلى الإجراءات التي تنظم سير الخصومة أمام المحكمة التجارية المتخصصة. إستجابة من المشرع الجزائري لضرورة تطوير الجهاز القضائي المتخصص بما يتماشى مع مستجدات المجال التجاري وماينبثق عنها من قضايا ونزاعات ذات طبيعة خاصة، مع الإبقاء على القسم التجاري العادي مما يقتضي توزيع الاختصاص بينهما وفق قواعد خاصة. Abstract: In line with developments in the field of business and trade and the need to attract investors, improve the business climate and the consequent commercial disputes of a special nature, and in order to find effective mechanisms for their settlement, the Algerian legislator is directed towards devoting a specialized judicial system to consider commercial disputes of a special nature in order to preserve the elements of speed and credit on which commercial activity is based in order to achieve complete and speedy justice. Where an update was made in the judicial organization and division under Judicial Division No. 07-22 of 05/05/2022, as well as the amendment of the Civil and Administrative Procedures Law by Law No. 22-13, where it enshrined the idea of a specialized judiciary by developing a system for commercial courts and assigned them the authority to adjudicate some cases that are exclusively competent to consider them with a judge and four assistants who have competence and effectiveness to settle commercial disputes, in addition to the procedures that regulate the conduct of litigation before the Specialized Commercial Court. In response from the Algerian legislator to the need to develop the specialized judicial system in line with the developments in the commercial field and the issues and disputes of a special nature that emerge from it, while maintaining.
