النزاع التجاري على ضوء مستجدات القانون الجزائري Commercial Disputes In The Light Of Recent Legal Developments In Algeria

Résumé: استحدث المشرع الجزائري تنظيم خاص للنزاع التجاري يتماشى مع مستجدات مناخ الأعمال بعد صدور قانون الاستثمار لسنة2022، والعمل على تكريس قضاء تجاري متخصص بداية من صدور القانون العضوي 22-10 والقانون رقم 22-13 بهدف توفير الأمن القضائي للمتنازعين، وعليه، تم استحداث المحاكم التجارية المتخصصة تتولى سلطة النظر في الدعاوى المحصورة في المادة536 مكرر من ق.إ.م.إ الجديد وذلك إلى جانب الأقسام التجارية، بالإضافة إلى تفعيل إجرائي الصلح والوساطة في هذا المجال. The lawmakers of Algeria have offset the existing business climate created by the new 2022 Investment Law with a new system for the solution of commercial disputes independently. This initiative aims at creating a separate commercial judiciary, under Organic Law 22-10 and Law No. 22-13, which shall guarantee judiciary security for those in dispute. In this direction, one has established specialized courts of commerce that will handle the cases provided for by Article 536 bis of the new C.C.A.P., in addition to the commercial divisions. Also,mechanisms of reconciliation and mediation have been strengthened with a view to encouraging amicable settlement in this area.
