محكمة التحكيم الرياضية الدولية آلية قانونية لحل النزاعات الرياضية The International Court Of Sports Arbitration As A Legal Mechanism For Resolving Sports Disputes.

Résumé: شهدت الرياضة تطورا ملحوظا في العقود الماضية، هذا ما أدى إلى ارتفاع عدد النزاعات المترتبة عنها مع زيادة تعقيداتها هذا ما استوجب وسيلة فعالة و سريعة لحل مثل هذه النزاعات من طرف أشخاص متخصصين و ذوي خبرة و مؤهلات في المجال الرياضي،لاسيما بعد أن أصبحت الرياضة من بين اهتمامات الدول. فالنزاع الرياضي هو بحاجة إلى قضاء متخصص على أساس أن القضاء العادي، لن يستطيع الفصل في مثل هذه النزاعات لعدم درايته الواسعة بهذا المجال و نظرا للاختلاف بينه وبين القضاء العادي من عدة جوانب سواء من حيث مضمونه و الاجراءات المتبعة فيه وطبيعته بالإضافة إلى القرارات التي تصدر في شأنه. كما أن النزاع الرياضي خرج من طابعه الداخلي إلى الطابع الدولي هذا ما أدى إلى إنشاء محكمة التحكيم الرياضية الدولية و التي اعتبرت من بين الهيئات المختصة بالنظر في النزاعات الرياضية عن طريق التحكيم و الوساطة إذ تعتبر أعلى هيئة قضائية في سويسرا حيث تفصل في النزاعات كدرجة ابتدائية و في حالات أخرى درجة استئناف كما تعتبر قراراتها ملزمة ونافذة على جميع الأطراف. A remarkable development is witnessed in sports last decades, which led to an increase in the number of disputes resulting from them with increasing complexity, that necessitated an effective and quick way to resolve such disputes by specialized people with experience and qualifications in the field of sports, and especially when the sport became among the states' concerns. The sports conflict is in need to a specialized judiciary on the basis that the ordinary one will not be able to adjudicate in such conflicts because of its wide knowledge of this area and because of the difference between it and the ordinary judiciary in many aspects, both in terms of content, procedures, and nature, in addition to the decisions issued in the same way. The sports dispute has gone from its internal character to the international character. This led to the establishment of the International Court of Sports Arbitration, which was considered among the competent bodies for the consideration of sports disputes through arbitration and mediation. It is considered as the highest judicial body in Switzerland, in which disputes are classified as a first instance and in other cases an appeal, and their decisions are obligatory and binding on all parties.
