Résumé: ملخص: تكتسي عملية استثمار الأملاك العقارية الوقفية أهمية بالغة في ضمان استمرارية أداء الوقف في تقديم خدماته وتحقيق أهدافه، المتمثلة في اكتساب الأجر والثواب، وتحقيق التنمية الشاملة في شتى المجالات. وبما أن الأملاك العقارية الوقفية تمثل أهم المجالات التي يمكن الاستثمار فيها، على اعتبار أن أغلب الأملاك الوقفية في الجزائر تتشكل من عقارات يمكن استغلالها، فقد نظم المشرع الجزائري شروط وكيفيات استغلالها من طرف المستثمر الذي تربطه مع السلطة المكلفة بالأوقاف عقد إداري يمنح له حق الانتفاع دون التملك ،بموجب المرسوم رقم 18-213 الذي نظم طريقة استغلال الأملاك العقارية الوقفية المبنية وغير المبنية باستثناء العقارات الفلاحية التي تخضع للمرسوم التنفيذي رقم 14-70 المؤرخ في 10 فبراير 2014. Abstract: The process of investing endowment real estate is extremely important in ensuring the continuity of the endowment’s performance in providing its services and achieving its goals, represented in gaining remuneration and reward, and achieving comprehensive development in various fields. Since endowment real estate represents the most important areas in which it can be invested, given that most of the endowment properties in Algeria consist of real estate that can be exploited, the Algerian legislature has organized the conditions and methods for their exploitation by the investor who binds him with the authority in charge of endowments an administrative contract that grants him the right to usufruct without Ownership, pursuant to Decree No. 18-213 that regulated the method of utilizing endowment real estate, both built and unconstructed, with the exception of agricultural real estate subject to Executive Decree No. 14-70 of February 10, 2014.
