الضمانات الممنوحة للمرأة الحامل العاملة في القانون الجزائري The Guarantees Offered In The Algerian Law For The Working Pregnant Women

Résumé: تشكل عطلة الأمومة محورا قانونيا أساسيا في الاتفاقيات الدولية للعمل و التشريعات المقارنة بصفة عامة، وفي القانون الجزائري بصفة خاصة، حيث اعترف بها المشرع الجزائري كحق للمرأة العاملة وأحاطها بشروط وإجراءات معينة ورتب عليها آثارا معينة، كما أنه أحاطها بضمانات لحمايتها خلال هذه العطلة تكفل لها الاستقرار على الصعيدين المهني والأسري. كما جدد المشرع اهتمامه بالوضع الحساس للمرأة الحامل مؤخرا باتخاذ إجراءات وقائية اتجاه المرأة الحامل في ظل انتشار وباء كورونا( كوفيد 19)، من خلال تقرير عطلة استثنائية في حقها مدفوعة الأجر. Maternity leave constitutes an essential legal axis in international labor agreements and comparative to the legislation in general, and in the Algerian law in particular, where the Algerian legislator recognized it as a right for working women, surronded it with certain conditions and procedures and arranged specific effects on it. As he also enclosed her with safeguards to protect her during this holiday, ensuring her stability at the professional and family levels. The legislator also renewed its interest in the sensitive situation of pregnant women ricently by taking preventive measures towards women in lightning of the spread of the Corona epidemic (covid 19), through the determination of an exceptional vacation in which it is paid.
