Résumé: ملخص شغور منصب رئيس الجمهورية أثناء ممارسة عهدته الانتخابية يعني وضعا دستوريا دقيقا، يستوجب حسن تنظيمه في الأحكام المتعلقة به، وتتأتى أهميه هذا الموضوع كونه يضمن التوازن بين المصلحة العامة والخاصة به، ومعطى رئيسي في استقرار النظام الدستوري للبلاد واستمرارية الدولة، لذلك فهل عالج الدستور حالة الشغور بالشكل الكافي موضوعيا وإجرائيا بما يضمن تحقيق هذه الغاية؟. وكنتيجة أبانت التجربة الدستورية الجزائرية عن ضعف معالجته، وكيفيات التطبيق التي نتجت عليها اختلالات عديدة انتهت اغلبها بأوضاع غير دستورية، بسبب سوء الفهم، قصور التنظيم، التفسير السياسي، تخاذل المؤسسات، مكانة المنصب وشخصنته، والظروف التي تميز الحياة العامة، مما يستوجب إيجاد حلول تساهم في معالجته. Abstract The vacancy of the position of the President of the Republic during the exercise of his electoral mandate means a precise constitutional situation, which requires good organization in the provisions related to it, and its importance comes as it ensures a balance between public and private interests, and a key factor in the stability of the constitutional system of the country and the continuity of the state, so did the constitution address the state of vacancy in the form Sufficient objectively and procedurally to ensure the achievement of this end? As a result, the Algerian constitutional experience showed the weakness of its treatment, and the methods of implementation that resulted in many imbalances, most of which ended in unconstitutional conditions, due to misunderstanding, lack of organization, political interpretation, institutional weakness, position and personalization of the position, and the circumstances that characterize public life, which requires finding solutions that contribute in its treatment.
