الحوار الإجتماعي كآلية إستراتيجة لممارسة الحق النقابي في ظل القانون 23/02 المتعلق بممارسة الحق النقابي

Résumé: الملخص: تعد النقابات وليدة الثورة الصناعية والتي تضم مجموعة من العاملين في نفس المهنة ،وتدعو هذه النقابات إلى إيجاد مجتمع لتستطيع من خلاله تحقيق مطالبها المختلفة من أجل الحصول على مساحة تلاقي وإمكانية التفاهم بيناطراف الانتاج الثلاثة، وكذلك فرصة لهم من أجل الضغط على الحكومة، وتقوم بذلك من خلال تأثيرها في صنع السياسة العامة بشتى الوسائل منها :الإضرابات والحوارات الجماعية، الإعتصامات في قليل من الأحيان وقد برز هذا التأثير إثر صدور دستور 1989 المعدل والمتمم الذي نجم عنه التحولات الإقتصادية والإجتماعية التي عرفتها الجزائر نهاية الثمانينات من القرن الماضي .وقد أكد هذا الدستور على مبدأ الحرية النقابية في الإنضمام إلى أي تنظيم نقابي ،مع التأكيد على ممارسة حق التفاوض الجماعي مع أصحاب العمل .كما أن المتتبع لعلاقات العمال في الجزائر يلاحظ أن أقل تأثير للنقابات كان قبل صدور دستور 1989 ،نظرا لكون الإتحاد العام للعمال الجزائريين النقابة الوحيدة المسيطر عليها من قبل حزب جبهة التحرير الوطني، إلا أنه وبعد صدور هذا الدستور الذي سمح لها بالتعددية، أصبحت أكثر تأثيرا في النظام السياسي ،وخاصة في صنع السياسة العامة ،من أجل النهوض بالمجالات الثلاث الإقتصادي والسياسي والإجتماعي. . وتهدف هاته الدراسة على تأكيد قانون 23/02 المتعلق بممارسة الحق النقابي على إعتبار الحوار الإجتماعي الوسيلة المثلى للحفاظ على المصالح المادية والمعنوية،منها والجماعية والفردية وكذا المصالح الإقتصادية والإجتماعية ، للعمال الأجراء ومصالح المستخدمين، إلا أنه ورغم ذلك مازالت النقابات المستقلة، مستبعدة من جلسات الحوار الإجتماعي في الجزائر. الكلمات المفتاحية: السياسة العامة ،قانون 90/14،قانون 23/02،الحق النقابي،المنظمة النقابية.الحوار الإجتماعي. Abstract The union is the offspring of the industrial revolution which includes a group of workers in the same profession .these unions call for creating a society so it can get through it.it can achieve its various demands in order to abtain a space of meeting.and the possibility of understanding between the three production parties.as well as an apportunity for them to put pressure on the goverrnment and do so through its impac on public policy making by various means including strikes collective dialogues .and sit –ins at times this has emerged influence after the issuance of the 1989 constitution that resulted .from the economic and social transformations that algeria experienced at the end of the eighties of the last century this constitution affirmed the principle of freedom of association to join any trade union organization while affirming the exercise of the right to collective negotiation with employers as well as the tracker of relations working in algeria notes that the union were the least influential before the 1989 constitution given that the general union algerian workers was the only controlled by the national liberation front party and only after the issuance of this constitution that allowed for pluralism it became more influential in the political system especially in marking politic policy for the advancement of the advancement of the three economic political and social magazines. This study aims to confirm the law 23/02 considering social dialogue as the best means to preserve the material and moral interests of salaried workers and the interests of employees.however despit this independent unions are still excluded from social dialogue sessions in algeria.
