طرق تكوين حافظة العقار الاقتصادي في التشريع الجزائري The Ways To Form The Economic Real Estate Portfolio In Algerian Legislation

Résumé: يسبق مرحلة منح الامتياز في ظل القانون 23-17 مرحلة أولية تتمثل في تكوين حافظة العقار الاقتصادي من قبل الوكالة الجزائرية لترقية الاستثمار ، لذلك فهدفنا وراء الدراسة هو تبيان مجمل الطرق التي نظمها المشرع الجزائري من أجل تكوين حافظة العقار الاقتصادي وفق المرسوم التنفيذي رقم 23-486 ، و تتمثل هذه الطرق في إما بالاكتساب بالطريق العادي عن طريق اقتناء العقار من مالكه ، أو عن طرق غير عادي إما بالشفعة الإدارية أو نزع الملكية للمنفعة العامة ، أو بطريقة التطهير باسترجاع الأوعية العقارية المتوفرة أو الفائضة عن حاجيات المؤسسات العمومية الاقتصادية ، أو عن طريق استرجاعها من المستثمرين المخلين بالتزاماتهم. The concession phase under Act No. 23-17 precedes the initial phase of the formation of the economic real estate portfolio by the Algerian Investment Promotion Agency. "Our objective behind the study is to outline the ways in which Algerian legislation has organized to form the economic real estate portfolio in accordance with Executive Decree No. 23-486, These methods are either by acquiring the normal way by baying the real estate from its owner or extraordinary way of either administrative litigation or expropriation for public benefit, or by clearing the available or surplus real estate receptacles to the needs of public economic institutions, or by retrieving them from investors in breach of their obligations.
