حق المستهلك في العدول في التشريع الجزائري Consumer Right Of Cancellation In Algerian Legislation

Résumé: يعد الحق في العدول آلية قانونية، استحدثها المشرع الجزائري في محاولة منه إلى تحقيق أقصى حماية ممكنة للمستهلك أمام احترافية المهني الذي يستعمل كافة وسائل الدعاية و الإشهار لإغراء المستهلك الضعيف للتعاقد معه، حيث أنه من خلال ممارسة حق العدول يتمكن المستهلك بالتراجع عن العقد الذي يكون قد يبرمه متسرعا دون تفكير مليّ، في مدة حددها القانون تختلف حسب طبيعة المنتوج محل العقد، ويكون ذلك العدول بإعادة المنتوج إلى المحترف على حاله أي في غلافه الأصلي كما تسلمه منه، دون الحاجة إلى إبداء أية أسباب ودون تحمل مصاريف إضافية، ويقوم هذا الأخير بإعادة الثمن الذي قبضه من المستهلك، وليس له رفض ذلك العدول Abstract: The right to cancel is a legal mechanism created by the Algerian legislator in attempt to achieve the maximum possible protection of the consumer, facing the proficiency of professional who uses all means of advertising and publicizing to entice the weak consumer to contract with him. By exercising the right of cancellation, the consumer can withdraw the contract concluded without thinking in a period specified by law and varies according to the nature of product. The cancellation should be done by returning the product to the professional in the same manner as in the original received packaging, without the need to give any reasons and without incurring additional expenses. The professional should return the collected price, and shouldn’t reject this cancellation
