الطبيعة القانونية للتبليغ عن جرائم الفساد في التشريع الفلسطيني (دراسة قانونية تحليلية مقارنة مع التشريع الكويتي)

Résumé: ملخص: يتنـاول هـذا البحـث موضوع التبليغ عن جرائم الفساد فـي التشـريع الفلسطيني والكويتي؛ للتعرف على طبيعته القانونية، وذلــك مــن خــلال تحليل النصـوص الناظمة؛ للتبليغ في قانون مكافحة الفساد الفلسطيني. وكذلك مقارنتها مع الأحكام ذات العلاقة في موضوع التبليغ عن الفساد في التشريع الكويتي. ومن ثم تعـرض البحـث إلـى ماهية التبليغ عن جرائم الفساد والأساس القانوني له، وكذلك آثاره القانونية بالنسبة للفرد والموظف العام والمتهم في جرائم الفساد في كل مـن التشريعات محل الدراسة، وقـد خلصـت الدراسـة إلـى وجـود قصور في بعض أحكام التبليغ في التشريع الفلسطيني وما ترتب عليه من آثار انعكست سلبا على مكافحة الفساد. الأمر الـذي ساهم بوضع النتائـج والتوصيـات. Abstract: This research deals with the reporting of corruption crimes in Palestinian legislation in order to identify its legal nature through analyzing the legal provisions governing the reporting of corruption in the Palestinian Anti-Corruption law. It also compares it with the relevant provisions on reporting corruption in Kuwaiti legislation. Research is thus presented on what is the reporting of corruption crimes and its legal basis; it also had legal implications for the average individual, public official, defendant and accomplice to corruption crimes in each of the legislation in question. The study had concluded that there were deficiencies in some of the reporting provisions in Palestinian legislation and the consequent impact of such inadequacies on the foot of reporting corruption, which had contributed to the development of findings and recommendations.
