تكييف ظاهرة اللجوء البيئي وفق القانون الدولي Adapting The Phenomenon Of Environmental Asylum In Accordance With International Law

Résumé: ملخص: إن تداعيات الأوضاع السياسية والإقتصادية والبيئية تفرض على الأفراد أحيانا ترك أوطانهم بحثا عن الأمن والغذاء؛ سواء كان ذلك بإرادتهم المحضة أو مجبرين على ذلك، إلا أن المنظومة القانونية الدولية تفتقر إلى النصوص التي يعلن من خلالها المجتمع الدولي إعترافه بهؤلاء اللاجئين بفعل الظروف البيئية الرديئة أو الكوارث الطبيعية وتكفل له الحماية اللازمة. وسنحاول التطرق لمضامين الإتفاقيات والصكوك الدولية، لاستخلاص بعض المقاربات القانونية التي قد يستند عليها أعضاء المجتمع الدولي للمطالبة بحقوق اللاجئين البيئيين وحمايتهم. وفي مقابل ذلك فإن الجهود الدولية الرامية إلى حماية وديمومة الجنس البشري وفق ما سمي بالتنمية المستدامة في إطار حماية البيئة، هما مؤشران في حاجة للتوفيق بينهما. .كلمات مفتاحية: ظاهرة اللجوء، اللاجئ البيئي، الكوارث البيئية، القانون الدولي Abstract: The repercussions of the political, economic and environmental conditions sometimes force individuals to leave their homelands in search of security and food. Whether by their own free will or forced to do so, the international legal system lacks texts through which the international community declares its recognition of these refugees due to poor environmental conditions or natural disasters and guarantees them the necessary protection. We will try to address the contents of international conventions and instruments, to extract some legal approaches upon which members of the international community may rely to claim the rights and protection of environmental refugees. On the other hand, international efforts aimed at protecting and sustaining the human race according to what is called sustainable development within the framework of environmental protection are two indicators that need to be reconciled.
