تأثير جزر البليار على التحديد البحري بين الجزائر واسبانيا

Résumé: الملخص: أصدرت الجزائر في مارس 2018 مرسوما رئاسيا يتضمن الإعلان عن منطقة اقتصادية خالصة قبالة سواحلها بامتدادات بحرية في اتجاه الشمال وفق إحداثيات منصوص عليها في المرسوم ذاته وهي الإحداثيات التي اعتمد فيها المشرع الجزائري التصور القائم على خط الوسط بين كل من اسبانيا وايطاليا دون اعتبار للجزر من حيث التأثير على عملية التحديد البحري. عند مطابقة تلك الإحداثيات على الخريطة، فان الحد الخارجي للمنطقة الاقتصادية الخالصة الجزائرية نجده يلامس شواطئ جزر البليار وبالتحديد المحمية الطبيعة الخاصة بجزيرة كابريرا بما يفهم منه أن الجزائر لا تعير اهتماما كبيرا للتصور الجامد الخاص بخط الوسط وبالمقابل ترى أن موقع جزر البليار لا يمكن أن يكون له تأثير على عملية التحديد و هو التصور الذي يعكس تماما موقف الجزائر التي كانت دائما تنادي به خلال مفاوضات المؤتمر الثالث لقانون البحار خاصة فيما يتعلق بمفهوم الجزيرة والحقوق التي يمكن أن ترتبها لها الاتفاقية بالنسبة للامتدادات البحرية و في مقدمتها الحق في منطقة اقتصادية خالصة وفق الجزء الخامس من اتفاقية 1982. الكلمات المفتاحية: الجزيرة - المنطقة الاقتصادية الخالصة - التحديد البحري - الصخور البحرية -الأثر الكامل. Abstract: In March 2018, Algeria issued a presidential decree announcing the creation of an exclusive economic zone off its coast with extensions to the north in accordance with the coordinates stipulated in the same decree, where the Algerian legislator adopted the principle of the middle line between Spain and Italy regardless of the islands. -Algeria's exclusive economic zone has created an area of overlap with the waters of the Balearic Islands, namely the Cabrera Island Nature Reserve, which is understood as such that Algeria does not give much importance to the rigid notion of the middle line, and in turn, the location of the Balearic Islands cannot have an impact on maritime delimitation between the two states , which fully reflects the position of Algeria, which it has always defended during the negotiations of the Third Conference on the Law of the Sea, in particular with regard to the legal concept of the island and the rights that It can be given by the Convention on Maritime Extensions, mainly the right to an exclusive economic zone in accordance with Part 5 of the 1982 Convention
