عقوبة العمل للنفع العام من منظور التشريع الجزائري، Punishment Based On Public Benefits From The Perspective Of Algerian Legislation

Résumé: دراسة هذا الموضوع استدعت البحث في مدى مسايرة المشرع الجزائري للتشريعات العالمية التي تعمل على تفادي تقييد حرية المحكوم عليهم وذلك باستحداث عقوبة العمل للنفع العام كبديل عن عقوبة الحبس تحقيقا لسياسة إعادة الإدماج الاجتماعي للمحكوم عليهم دون تقييد حريتهم ودون إبعادهم عن المجتمع وعن وسطهم مع قيامهم بعمل يفيد في إصلاحهم من حيث عدم إختلاطهم بغيرهم من المجرمين وإبعادهم عن الآثار السلبية التي قد تتركها الحياة داخل المؤسسة العقابية هذا من جهة ، ومن جهة ثانية هذا العمل يفيد أيضا في تقليص المصاريف على خزينة الدولة. وتم الاستخلاص أن الصعوبات التي اعترضت تطبيق عقوبة العمل للنفع العام في الجزائر ولازالت تعترضها تعتبر طبيعية كما هو الشأن بخصوص تجارب الجزائر في مواضيع أخرى، غير أن توافر الإرادة لدى الجميع، ابتداء من ايمان القضاة الراسخ بنجاعتها في معالجة انحراف المبتدئين وتجنيبهم مآسي الحبس وأثاره، وكذلك وعي المجتمع بأهمية مشاركته في العملية من خلال مؤسساته، هما الركائز الأساسية دون إهمال باقي العوامل الأخرى كالتدريب وتوفير الوسائل اللازمة للمتابعة. The present study necessitated to research the considerable attempts of the Algerian legislator to keep up with the universal legislations that work at avoiding the restriction on freedom of sentenced persons by introducing punishment based on public benefits as an alternative to a prison sentence, implementing policies, socially reintegrating sentenced persons without restricting their liberties and without getting them out of their society and environment. At the same time, they fulfill a work that would help them reform themselves and stay away from criminals and negative effects often caused by living inside the jail. This is from one hand, from the other hand; such work would also help to reduce expenditures of the state. What has been concluded is that the difficulties which are still facing the implementation of punishment based on public benefits in Algeria are considered ordinary just like some other experiences Algeria is facing in other fields. The will of all, starting by a firm belief of judges of the efficiency of this kind of punishment in treating juvenile delinquency and sparing them tragedies and effects of the prison. The society must be aware of the importance of its contribution throughout its establishments. These are the main pillars without neglecting other factors such as trainings and providing the necessary instruments of supervision.
