نحو تكريس تطبيق عقوبة العمل للنفع العام كعقوبة أصلية في التشريع الجزائري

Résumé: كيف المشرع الجزائري النظام القانوني الداخلي حتى تتماشى سياسته العقابية وما طرأ في العالم من تغير، فأعد نطاقًا قانونيا رسم فيه الإطار العام لشروط وكيفيات تطبيق عقوبة العمل للنفع العام مع مراعاة جميع خصائصها من ردع وإصلاح وهذا للوصول إلى الهدف الأسمى للسياسة العقابية ، فتهدف هذه الدراسة إلى بيان مدى نجاعة عقوبة العمل للنفع العام إلى درجة إمكانية جعلها عقوبة أصلية يمكن للقاضي النطق بها وحدها . Abstract: Abstract The Algerian legislator wrote down the internal legal system in order to be in line with its punitive policy and the change that has occurred in the world, so he prepared a legal scope in which he drew the general framework for the conditions and modalities of applying the labor penalty for the public benefit, taking into account all its characteristics of deterrence and reform and this to reach the ultimate goal of the punitive policy, this study aims to show the effectiveness of the labor penalty for the public benefit to the extent that it can be made an original penalty that the judge can pronounce alone key words:
