رقابة المطابقة في إطار ضمان فعالية وتنفيذ الالتزام بالمطابقة. - دراسة على ضوء القانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش- Compliance Control Within The Framework Of Ensuring The Effectiveness And Implementation Of The Compliance Obligation. -a Study In Conformity With The Law N° 09/03 Related To The Protection Of The Consumer And Antifraud-

Résumé: كرّس المشرع بموجب القانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش، مجموعة من الضمانات القانونية لمصلحة المستهلك، والتي جاءت في شكل التزامات قانونية تقع على عاتق المتدخل في عملية العرض للاستهلاك، ومن بينها وأهمها "الالتزام بمطابقة المنتوجات"، وذلك بالنظر لما يمكن أن يقدمه هذا الالتزام من ضمان أوفر وأوسع في إطار حماية المستهلك باعتباره الحلقة الضعيفة في العلاقة الاستهلاكية، ومن أجل ضمان فعالية وتنفيذ الالتزام بالمطابقة نص على رقابة المطابقة كآلية قانونية تُمارَسُ على جميع المنتوجات الوطنية منها والمستوردة وبطرق مختلفة مع اتخاذ التدابير الوقائية اللازمة في حالة ضبط منتوجات غير مطابقة، وهو ما يندرج ضمن الحماية الوقائية للمستهلك. The legislator devoted according the law n° 09-03 related to the protection of the consumer and the fighting of the fraud, some of the law abbiding for the benefit of the consumer, these in a form of law abbiding obligations which is the responsability of the actor in the process of the supply in rise, the fundamental elements « obligations in conformity with the products », the obligations presents an ample and large guarantee as part of the protection of the consumer the weakest part, the consumption relation and in order to get an effective guarantee and applying the obligations for the conformity, the law maker states also upon the conformity control as a lawful mechanism practised over all the national products and the imported ones, using defferent ways taking into account the necessary preventive conditions in case of finding out fake products, which is included among the preventive protection of the consumer.
