الالتزام بالمطابقة كآلية لضمان جودة المنتجات في عقود الاستهلاك في التشريع الجزائري Commitment To Conformity As A Mechanism To Ensure The Quality Of Products In Consumer Contracts In Algerian Legislation

Résumé: الملخص: لقد جاءت هذه الدراسة للوقوف على مدى فعالية المطابقة في ضمان جودة المنتوجات وتحقيق حماية فعالة للمستهلك من خلال التطرق إلى المواصفات والمقاييس القانونية والتنظيمية، وكذلك المواصفات المشترطة من قبل المستهلك والمبنية على رغبته المشروعة في المنتوج. ولضمان مطابقة فعلية للمنتوجات فرض المشرع بمقتضى القانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش المعدل والمتمم على المتدخل، ضرورة إجراء رقابة على مدى مطابقتها قبل عرضها للاستهلاك، كما تم وضع أجهزة فعالة تتولى تنظيم التقييس سواء على المستوى الوطني أو الدول Abstract This study came to determine the extent of the effectiveness of conformity in ensuring the quality of products and achieving effective consumer protection. This is done by addressing the specifications, and the legal and regulatory standards, as well as the specifications required by the consumer based on his legitimate desire for the product. In order to ensure the actual conformity of the products, the legislator imposed on the intervener under Law No. 09-03 relating to consumer protection and the repression of fraud modified and supplemented the necessity of conducting a control over their conformity before offering them for consumption; also, Effective bodies have been put in place to regulate standardization, whether at a national or international level.
